Commission on State Mandates tentatively approves new mandate

On March 5th, the Commission on State Mandates (COSM) issued its draft decision to approve the Public School Restrooms: Feminine Hygiene Products test claim
A big shout out to Desert Sands Unified School District for doing the heavy lifting and filing this test claim!
What’s the requirement?

Education Code Section 35292.6: A public school maintaining any combination of classes from grade 6 to grade 12, inclusive, that meets the 40-percent pupil poverty threshold, shall stock at least 50 percent of the school’s restrooms with feminine hygiene products at all times.
What do the reimbursable activities look like?

Time and costs to stock the restrooms

Time and cost to train staff on the new state mandated activities
-
Time and cost to update district policies and procedures
-
Costs to purchase and install dispensers for the restrooms
-
Costs incurred starting January 1, 2018 forward can be claimed
What is the timeline?

State filing deadline is anticipated to be sometime late December, 2019

Formal approval is set to take place when COSM holds its next meeting on May 24, 2019
